By accessing or using the Novisurf AI Gateway platform, API, dashboard, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Novisurf ("we," "us," or "our").
Novisurf is an AI gateway platform that provides access to large language models, image generation capabilities, retrieval-augmented generation (RAG) pipelines, and proprietary AI models including unseen-v1. The Service is provided via API and web dashboard to developers and businesses.
You must create an account to access the Service. You agree to provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your API keys and account credentials. You must notify us immediately at team@novisurf.top if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
The Free Tier is provided exclusively for testing, evaluation, and development purposes only. Commercial use of the Free Tier is strictly prohibited. This includes but is not limited to:
Users found to be using the Free Tier for commercial purposes will have their accounts suspended without notice. To deploy Novisurf in a production or commercial environment, you must upgrade to a paid plan.
Paid plans are available for production and commercial use. Pricing, rate limits, and feature availability are detailed on our pricing page. We reserve the right to modify pricing with reasonable advance notice.
All tiers are subject to rate limits. Attempting to circumvent rate limits through multiple accounts, credential sharing, or any other means is a violation of these Terms.
You agree not to use the Service to:
Your API keys are confidential. You must not share, expose, or embed API keys in publicly accessible code repositories, client-side code, or any publicly accessible location. You are fully responsible for all usage and charges incurred under your API keys. Novisurf is not liable for unauthorized usage resulting from your failure to secure your credentials.
You retain ownership of the prompts and inputs you submit to the Service. By submitting content, you grant Novisurf a limited, non-exclusive license to process that content solely for the purpose of providing the Service.
You own the output generated through your use of the Service, subject to the limitations of these Terms and any applicable third-party model licenses. Novisurf makes no warranty that generated outputs are free from third-party intellectual property claims.
All rights in the Novisurf platform, API, dashboard, unseen-v1, and related technology remain the exclusive property of Novisurf. Nothing in these Terms grants you any rights in our intellectual property.
We collect and process data in accordance with our Privacy Policy, available at novisurf.top/privacy. By using the Service, you consent to such processing. We do not sell your personal data or use your inputs to train our models without your explicit consent.
We strive for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, third-party infrastructure issues, or events beyond our control may result in downtime. We are not liable for losses resulting from Service unavailability.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. NOVISURF DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED OUTPUTS MAY BE INACCURATE, INCOMPLETE, OR INAPPROPRIATE — YOU ARE SOLELY RESPONSIBLE FOR HOW YOU USE THEM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVISURF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO NOVISURF IN THE 30 DAYS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Novisurf, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion. Upon termination, all licenses granted to you cease immediately. Provisions that by their nature should survive termination shall do so, including Sections 7, 10, 11, and 12.
